1. Premises and Acceptance

These General Terms and Conditions of Sale (hereinafter "GTC") govern the purchase of products offered on the website hairrebirth.it (hereinafter the "Site") owned by the company Salus Labs International LLC - 16192 Coastal Highway - 19958 Lewes - Delaware - United States

(hereinafter "Salus Labs" or the "Seller").

  • 1.1. Scope of Application: The GTC apply exclusively to purchases made by "Consumers" (natural persons acting for purposes unrelated to their entrepreneurial, commercial, artisanal, or professional activity) and are governed by Legislative Decree 206/2005 (Consumer Code) and Legislative Decree 70/2003 (E-commerce Regulations).

  • 1.2. Acceptance: Placing an order implies the full and unconditional acceptance of these GTC by the Customer.

  • 1.3. Changes: Salus Labs reserves the right to modify the GTC at any time. Changes will be effective from the moment of publication on the Site and will apply only to sales concluded thereafter.

2. Products and Orders

  • 2.1. Product Features: The essential characteristics of the products (including price, shipping cost information, and composition) are presented on the Site within each product sheet.

  • 2.2. Order: The order is considered completed only after the Customer has followed all the steps provided by the purchasing process, including final confirmation and payment.

  • 2.3. Order Acceptance: The order is considered accepted, and the contract is deemed concluded, at the moment Salus Labs sends the Customer an order confirmation email to the address provided by the Customer. Salus Labs reserves the right not to accept the order in case of product unavailability or for other legitimate reasons.

3. Prices and Payments

  • 3.1. Prices: The prices of the products are expressed in Euros (€), inclusive of VAT (if applicable for the product category) and include shipping costs.

  • 3.2. Payment Method: Payment for purchases on the Site is made via the PayPal payment platform or by cash on delivery. 

  • At the time of advance payment, the Customer will be redirected to the PayPal site to complete the transaction. Salus Labs does not store or process data related to the Customer's credit card or other payment instruments.

  • 3.3. Non-Payment: In case of non-receipt of payment, the order will be canceled.

4. Shipping and Delivery

  • 4.1. Times and Costs: Shipping costs are the responsibility of the Seller.

  • Shipping times vary depending on the destination and the courier used.

  • 4.2. Transport: Products are shipped to the address provided by the Customer. Delivery is considered completed when the Customer, or a third party designated by them, physically takes possession of the goods.

  • 4.3. Risks: The risk of loss or damage to the goods, for reasons not attributable to the Seller, transfers to the Consumer only at the moment when the latter (or a third party designated by them) physically takes possession of the goods.

5. Right of Withdrawal (Return)

  • 5.1. Exercise of the Right: The Consumer Customer has the right to withdraw from the contract, without providing reasons, within 14 days ("Withdrawal Period") from the day on which the Customer or a third party, other than the carrier and designated by the Customer, takes physical possession of the goods.

  • 5.2. Method of Exercise: To exercise the right of withdrawal, the Customer must inform Salus Labs of their decision through a clear statement sent via email to info@hairrebirth.it or through the Contact section of the website.

  • 5.3. Return of Products: Within 14 days of the withdrawal notification, the Customer must return the goods, which will be done free of charge via a courier appointed by the Seller.

  • The Product must be returned intact, unused, sealed in its original packaging and in perfect resalable condition. In the case of opened, used, or damaged products, the return will be considered invalid and no refund will be issued.

  • 5.4. Refund: Only in the case of a valid withdrawal, Salus Labs will refund the payment received from the Customer without undue delay and in any case no later than 14 days from the day we were informed of the decision to withdraw. The refund will be made using the same payment method used by the Customer for the initial transaction (PayPal), unless otherwise explicitly agreed in the case of cash on delivery. The refund may be suspended until the goods are received or until the Customer has demonstrated having returned the goods.

6. Legal Warranty

The Legal Warranty of Conformity provided by the Italian Consumer Code (articles 128 et seq.) applies to all products sold.

 

7. Processing of Personal Data (Privacy)

Salus Labs processes the personal data of the Customer in accordance with data protection regulations (EU Regulation 2016/679 – GDPR). Please refer to the specific Privacy Policy available on the Site.

 

8. Applicable Law and Jurisdiction

  • 8.1. Applicable Law: These General Terms and Conditions are governed by Italian law, excluding conflict of law provisions.

  • 8.2. Jurisdiction: For any dispute arising from the interpretation, execution, or termination of the Contract, the competent court will be that of the Consumer's place of residence or domicile, if located within the territory of the Italian State.

  • 8.3. ODR Platform: Consumers residing in the European Union or the United Kingdom can access the Online Dispute Resolution (ODR) Platform for the out-of-court resolution of disputes related to online sales contracts, available at the link: https://ec.europa.eu/consumers/odr/.
